They obviously believe that he fully thought she was 16, and all the circumstances showed that to be a completely plausible thing. Probably wheeled the girl out in court to show how old she looked. If the judge can look at her and think she looks old enough then she can see how the guy could. If the girl was 16 then there's no crime, the rest was consensual sex.
